1) On October 28th, 2020, the Privacy Commissioner of Canada released its investigation of the use facial recognition technology in a number of flagship shopping malls in Canada by Cadillac Fairview, the owner of the malls (the full OPC investigation is available here). Briefly explain how Cadillac Fairview’s response to the OPC investigation (see paragraphs 166-170 of the investigation) reveal the shortcomings of privacy regulations and/or enforcement in Canada. How would this surveillance initiative been constrained or altogether precluded had Cadillac Fairview attempted to establish such as system in the EU? Include a brief overview of the GDPR in your response.
2) The GDPR has been described as being ‘extra-territorial’ in effect. Explain what this effect is and the specific elements of EU privacy law (current and historically) that drive this effect. Describe how the approach taken by Canada to maintain equivalency with EU privacy regulations differs from that taken by the USA, and describe the current status of this equivalency in each both countries to the extent that it has been discussed in this course.
3) Burkell (2017) makes a series of arguments about the nature of surveillance today that make it difficult to imagine a return to anything akin to Levin’s ‘golden age of privacy,’ yet she is optimistic that we are nevertheless in the midst of redefining privacy for a new age in which the ‘right to be forgotten’ will be central. Summarize the key elements of Burkell’s arguments regarding surveillance today and the right to be forgotten. If Burkell is correct, what does this mean for the business model of surveillance capitalism as it has evolved in the last 15 years, and what considerations will future digital innovators need to take into account if they are to be successful?
